Who counts as a FinSA client advisor?

Under the Swiss Financial Services Act, client advisers are natural persons who perform financial services on behalf of a financial service provider or in their own capacity as financial service providers (Art. 3 let. e FinSA). Financial services are the following activities carried out for clients: the acquisition or disposal of financial instruments, the receipt and transmission of orders in relation to financial instruments, portfolio management, investment advice and the granting of loans to finance transactions with financial instruments (Art. 3 let. c FinSA). Every FinSA client advisor must have sufficient knowledge of the code of conduct set out in FinSA and the expertise required to perform their activities (Art. 6 FinSA).

Client advisers of Swiss financial service providers that are not supervised by FINMA, and client advisers of foreign financial service providers, may carry out their activity in Switzerland only if they are entered in a register of advisers (Art. 28(1) FinSA). Client advisers of foreign providers that are prudentially supervised abroad and serve exclusively professional or institutional clients in Switzerland are exempt (Art. 28(2) FinSA and Art. 31 FinSO). Our article Swiss Client Adviser Register: Who Must Register and How explains the registration conditions and the steps to the register.

Foreign providers and the Swiss client advisor register

This register makes sure that advisers who serve clients in Switzerland know the FinSA rules of conduct. For foreign firms, the position is as follows:

Situation of the foreign providerRegistration of its client advisers
not prudentially supervised in its home countryrequired
prudentially supervised abroad, serves retail clients in Switzerlandrequired
prudentially supervised abroad, serves exclusively professional or institutional clients in Switzerlandexempt (Art. 31 FinSO)

High-net-worth retail clients who have opted to be treated as professional clients still count as retail clients for this test, according to FINMA.

Frequently asked questions

What is a FinSA client advisor?

A FinSA client advisor is a natural person who performs financial services on behalf of a financial service provider or in their own capacity as a financial service provider (Art. 3 let. e FinSA). They must have sufficient knowledge of the FinSA code of conduct and the expertise required for their activities (Art. 6 FinSA). If the financial service provider is a Swiss provider not supervised by FINMA or a foreign provider, they generally also need an entry in a Swiss register of advisers (Art. 28 FinSA).

Do client advisers of foreign firms need to register in Switzerland?

Yes, as a rule. Under Art. 28 FinSA, client advisers of foreign financial service providers may only work in Switzerland once they are entered in a Swiss client adviser register. The duty applies in particular where the foreign provider is not prudentially supervised in its home country or serves retail clients in Switzerland.

Which foreign client advisers are exempt?

Client advisers of foreign providers that are prudentially supervised abroad are exempt if they serve exclusively professional or institutional clients in Switzerland (Art. 31 FinSO). According to FINMA, high-net-worth retail clients who have opted to be treated as professional clients still count as retail clients for this purpose.

Which course do I need for registration and for renewal?

The basic training is for your first entry in the register. The refresher is for renewing the registration, which is due no later than 24 months after registration (Art. 41(2) FinSO). Peak Compliance offers both courses online.

Is the training accepted by the registration bodies?

Yes. The Peak Compliance courses are accredited by BX Swiss AG (regservices.ch) and appear on its list of training providers. Both courses are also included in the list of the registration body RegFix.

How quickly can I start, and in which language?

Immediately. You receive your access details by email straight after your order and choose English or German as the course language.

What else is required for registration?

Besides knowledge of the rules of conduct, client advisers prove professional indemnity insurance or equivalent financial security and, where required, affiliation with an ombudsman's office (Art. 29 FinSA). The Peak Compliance training covers the knowledge requirement.

Which spelling does the Swiss client advisor register use?

Both spellings are in use for the Swiss register of advisers under FinSA: FINMA and the English version of FinSA write «client adviser» (Art. 28 FinSA), while registration bodies also use «client advisor», for example BX Swiss AG in the heading «Client Advisor Register». In German, the legal term is «Beraterregister». Whichever spelling you use, the entry is made by a registration body licensed by FINMA, and each registration body keeps its own register (Art. 31 and 32 FinSA).
